- All software provided by Westgate IT is on an "as is" basis with no warranties of any kind, and Westgate IT will not be liable for any damages of any kind arising from its use. Westgate IT Limited further disclaims all warranties, expressed or implied, including without limitation any implied warranties of merchantability or fitness for a particular purpose.
- Westgate IT Limited shall not be liable for any indirect, special, incidental or consequential damages (including damages for loss of business, profits, backup data or the like), whether based on breach of contract, tort (including negligence), product liability or otherwise, even if Westgate IT or its representatives have been advised of the possibility of such damages and even if a remedy set forth herein is found to have failed of its essential purpose.
- In consideration of the use of this software to provide services by the subscriber to any third parties, the subscriber hereby undertakes to indemnify and hold Westgate IT Limited harmless from and against all claims, suits, losses, liabilities (including Westgate IT's reasonable legal fees), damages cost and expenses from or in connection to the software and/or Westgate IT's services for whatever.
- Software license key(s) will be generated and sent to the subscriber when the total amount due for the services required is received by Westgate IT Limited.
- Subscriber shall keep the software licence key(s) confidential and shall never make them available to any third party.
- No subscriptions are refundable.
- A License key can only be used on one computer, and its use on multiple computers is not permitted. Violation of this restriction will result in a penalty equal to five times the normal license fee on each occasion.
